1. Identity of the seller
These general conditions of sale are offered by Sebastien KREISS, individual entrepreneur operating under the trade name Caspirolus, 450 route Ancienne de Flayosc, 83460 Les Arcs, France, SIREN 478 256 001, SIRET 478 256 001 00056, intracommunity VAT FR81478256001. 2. Scope
These conditions govern sales concluded on caspirolus.com between Caspirolus and any consumer. The customer declares to have the necessary legal capacity to contract and acknowledges having read these conditions before validating his order.
3. Products
The essential characteristics, dimensions, materials, patterns, options and prices of the products are indicated on the product sheets. The customer must verify the exact contents of the lot and the options selected before ordering. Colors may vary slightly depending on screens, prints and manufacturing series.
For personalized products, the customer is responsible for the quality, legality and rights of use of the images or content transmitted. Caspirolus may refuse content that is illicit, offensive or infringes the rights of a third party.
4. Price
Prices are displayed in euros, including all taxes where applicable. Delivery costs are indicated before final validation of the order. Caspirolus may modify its prices at any time, without effect on an order already validated.
5. Order
The customer selects the product, the reason and any options, checks their basket, enters their contact details then validates the payment. The order becomes final after confirmation of payment. A summary confirmation email is sent to the address provided by the customer.
6. Payment
Payment is made using the solutions offered during checkout. Transactions are processed by secure payment providers. Caspirolus does not store the customer's complete banking data.
7. Availability
Products are offered within the limits of manufacturing capacities and availability indicated. In the event of unavailability after ordering, the customer is informed and can accept a new deadline, choose an equivalent solution or obtain a refund of the sums paid.
8. Delivery
Caspirolus delivers to France and the 26 other European Union countries currently served. The available methods, their costs and estimated delivery times are displayed before validation of the order according to the delivery address. The customer must provide an accurate and complete address. The deadlines communicated are indicative and may be affected by external circumstances. The detailed terms and conditions are set out in the delivery policy.
9. Right of withdrawal
Unless there is a legal exception, the consumer has fourteen calendar days from receipt of the goods to notify their decision to withdraw, without having to justify it. The notification is sent to contact@caspirolus.com by means of an unambiguous declaration or the standard form available in the return and refund policy.
The consumer then returns the good without undue delay and at the latest within fourteen days following notification. The direct return costs are his responsibility. Its liability can only be incurred in the event of depreciation resulting from manipulations going beyond those necessary to establish the nature, characteristics and proper functioning of the good.
On a commercial basis, Caspirolus also accepts return or exchange requests up to the thirtieth day following receipt. From the fifteenth to the thirtieth day, the product must be complete, unused, unwashed, undamaged and in a condition allowing it to be put back on sale. This extension does not limit any legal rights.
10. Personalized products
The right of withdrawal does not apply to goods made according to the consumer's specifications or clearly personalized, in particular when a photo or visual provided by the customer is printed especially for him. This exception does not deprive the customer of his rights in the event of defect, damage or non-compliance.
11. Refunds
In the event of legal withdrawal, Caspirolus will reimburse the sums due, including the initial delivery costs corresponding to the standard method offered, without undue delay and at the latest within fourteen days following notification. Reimbursement may be deferred until recovery of the products or until proof of shipment is presented, whichever is earlier.
Reimbursement uses the same means of payment as that of the order, unless expressly agreed for another method not entailing costs. The supplement paid for delivery more expensive than the standard method is not refunded. Full details are provided in the Return and Refund Policy.
12. Legal guarantees
The consumer benefits from the applicable legal guarantees, in particular the legal guarantee of conformity and the guarantee against hidden defects. In the event of a defective or non-compliant product, the customer must contact Caspirolus describing the problem and attaching, if necessary, photographs.
13. Liability
Caspirolus cannot be held responsible for damage resulting from use contrary to the maintenance instructions, improper washing, modification of the product or abnormal use. No clause in these conditions limits the mandatory rights recognized to the consumer.
14. Intellectual property
Caspirolus' creations, visuals, texts, photographs and distinctive signs remain protected. The purchase of a product does not transfer any reproduction or exploitation rights to the associated designs and content.
15. Personal data
The data necessary for ordering, payment, delivery and customer service are processed in accordance with the privacy policy.
16. Claims and mediation
In the event of difficulty, the customer must first send a written complaint to contact@caspirolus.com. After a preliminary process which remains unresolved, the consumer can contact a consumer mediator free of charge. The contact details of the mediator appointed by Caspirolus will be communicated upon request and added to this page.
17. Applicable law
These conditions are subject to French law. In the event of a dispute, the mandatory rules of territorial jurisdiction applicable to consumers remain fully applicable.
